   How are buyers protected?
Buyers are protected when purchasing a vehicle in the Condition Guarantee by Seller Program in the following ways:
  1. All sellers in the program are verified licensed dealers.

  2.  
  3. Sellers uphold high standards in disclosing the vehicle condition in their listings.

  4.  
  5. Sellers agree to make all reasonable efforts to work directly with the buyer to resolve problems that arise from misrepresentation of the condition of the vehicle or omission of important, material details about the vehicle.

  7. If the buyer and seller are unable to work out any issues directly, sellers agree to enter mediation through SquareTrade's dispute resolution service at the buyer's request (the buyer pays a $30 mediation fee).

  9. If there is no resolution through the SquareTrade mediator, the buyer can request that the mediator escalate the case to eBay's insurer for a ruling. Sellers in the Condition Guarantee by Seller Program agree to comply with the third-party ruling.

  11. If the seller does not comply with the ruling, eBay's insurer may pay out to the buyer according to the ruling. Note: Only vehicles up to eight years old and with less than 125,000 miles are eligible for this added level of protection.    What are the responsibilities of the buyer?
Buyers who purchase a vehicle with a Condition Guarantee by Seller have important responsibilities:
  1. Buyers must exercise appropriate care when purchasing a motor vehicle. If a seller discloses a problem with the vehicle, it is the buyer's responsibility to research the full extent and nature of the problem before bidding. Any problems disclosed by the seller are not eligible for coverage under the Condition Guarantee by Seller Program
    • For example, if the seller discloses a "dent in the passenger side door", it is the buyer's responsibility to make sure that he or she has sufficient information to make a purchasing decision. A careful buyer in this situation might ask "Will you send me a picture of the dent?" or "May I get the car inspected?"

  2. Buyers must be the winning bidder or Buy It Now buyer of a passenger vehicle on eBay Motors. For reserve price listings, a winning bidder is the highest bidder who has met the reserve price.

  4. Buyers must be in good eBay standing at the time of the transaction, with a feedback score of at least zero.

  6. Buyers must inspect the vehicle thoroughly upon receiving it (either after picking it up at the seller's location or accepting shipment of the vehicle). To receive the full benefits of the Condition Guarantee by Seller Program, buyers must report any problems to the seller in writing within 24 hours for cosmetic (body and interior) issues and 72 hours for mechanical issues.

  8. Buyers must first make a good faith effort to work out issues with the seller before entering into mediation.

   What is the Condition Guarantee by Seller Process? Am I eligible for eBay coverage?
Here are the steps a buyer of a Condition Guarantee by Seller vehicle must follow if there is a material discrepancy between the description of the vehicle in the eBay Motors listing and its actual condition:
  1. Inspect the vehicle thoroughly immediately upon receipt of the vehicle.

  3. Contact the seller in writing (email or fax) within 24 hours for cosmetic (body and interior) conditions and 72 hours for mechanical conditions upon receipt of the vehicle. Save a copy of this initial correspondence as proof that you have notified the seller of a discrepancy between the listing description and the actual condition of the vehicle.

  5. Try to work out the issue directly with the seller. Sellers who are part of the Condition Guarantee by Seller Program are known for their customer service and for their commitment to the eBay community. Most issues are worked out in good faith between buyer and seller.

  7. If a problem persists after discussion with the seller, go to www.squaretrade.com and file a case for mediation. SquareTrade's Online Dispute Resolution service is free of charge; the assistance of a mediator costs $30. To move further in the Condition Guarantee by Seller process, a SquareTrade mediator must be employed.

  9. If there is no resolution by employing a SquareTrade mediator, you can request that your mediator escalate the case for ruling by eBay's insurer.
     
  10. You will be contacted by Auction Insurance Agency (AIA), eBay's insurer, who will require information regarding the dispute in order to make a ruling. You will be required to take the vehicle to an AIA-approved mechanic for an inspection or estimate of damage at your expense.

  12. You will receive a ruling from AIA regarding the dollar value of the extent of your eligible damage or loss.

  14. The seller will be obligated to pay you according to the ruling.

    Note: The seller may also choose to request a ruling, but you are not required to accept. If the seller chooses to request a ruling, he or she maintains the obligation to pay you according to the ruling.

    On certain eligible vehicles, the Condition Guarantee by Seller Program will offer this additional step:

  15. If the seller fails to pay you according to the ruling, you will be eligible for coverage from eBay according to the ruling and subject to the terms and conditions of the Condition Guarantee by Seller Program.

   What is the difference between the Condition Guarantee by Seller Program and Vehicle Purchase Protection?
Vehicle Purchase Protection is provided free of charge by eBay Motors to all passenger vehicle buyers to protect against cases of outright fraud or gross misrepresentation which results in a devaluation of at least 50% of the vehicle's purchase price, with a maximum coverage of $20,000 (additional coverage restrictions, conditions, and limits apply). Coverage also includes vehicles with undisclosed engine, transmission, or body damage where the cost of repair of any one of those components exceeds $1,500 (additional coverage restrictions, conditions, and limits apply).

The Condition Guarantee by Seller Program is meant to help resolve the vast majority of disputes that may arise between buyer and seller regarding disclosure of the condition of a vehicle. It covers buyers up to 50% of the vehicle's purchase price (with a maximum coverage of $10,000). Only certain vehicle purchases on eBay Motors are covered by the Condition Guarantee by Seller Program.

If the vehicle you have purchased is a Condition Guarantee by Seller vehicle, you must enter into the Condition Guarantee by Seller process. If the issue is escalated to a ruling, eBay's third party insurer, AIA, will determine qualifications and coverage under the appropriate program. A buyer of a Condition Guarantee by Seller Program vehicle may be eligible for coverage under either the Condition Guarantee by Seller Program or the Vehicle Purchase Protection Program, but a buyer is not allowed to collect on damage coverage under both programs. A buyer should not simultaneously file for a ruling under the Condition Guarantee by Seller Program and damage claim under the Vehicle Purchase Protection Program.
